A legal disclaimer

1. Services

 

Bilasuvar Painting provides residential and commercial painting and related services, which may include surface preparation, patching, priming, staining, minor drywall repair, caulking, and cleanup, as described in the estimate, quote, invoice, work order, or service agreement.

 

The exact scope of work for each project will be set out in writing and may include:

 

  • areas to be painted or serviced,

  • included preparation work,

  • products and materials to be used,

  • number of coats where specified,

  • exclusions,

  • pricing,

  • estimated schedule.

 

 

2. Quotes and Estimates

All quotes and estimates are based on the information available at the time of inspection or discussion.

Unless otherwise stated in writing:

  • quotes are valid for 15 days from the date issued,

  • prices are based on the described scope only,

  • hidden damage, unforeseen site conditions, or additional requests may result in extra charges.

Any verbal quote is non-binding unless confirmed by us in writing.

3. Changes to Scope and Extra Work

 

Any work outside the original agreed scope is considered extra work and may result in additional charges and schedule changes.

 

Extra work may include, for example:

 

  • additional rooms, walls, trim, ceilings, or surfaces,

  • extensive drywall/plaster repair,

  • water, mold, smoke, or structural damage,

  • removal of wallpaper, adhesives, heavy stains, or multiple failed paint layers,

  • changes in materials, colours, finishes, or product type,

  • furniture moving beyond normal light repositioning,

  • work required due to inaccurate site information provided initially.

 

We may document changes by written change order, email, text confirmation, invoice line item, or other written approval from you.

 

 

4. Deposits and Payment Terms

 

A deposit is not required before scheduling or starting work.

 

Unless otherwise stated in writing:

 

  • progress payments may be required for larger projects,

  • final payment is due immediately upon substantial completion or within 3 days of invoice date,

  • overdue balances may be subject to interest of 4% per month or the maximum permitted by law, whichever is lower.

 

We reserve the right to pause work or withhold scheduling of further work if payments are overdue.

 

 

5. Accepted Payment Methods

 

We accept payment by [e-transfer / cheque / bank transfer / credit card / Stripe, Square, Paypal invoice / cash].

 

Where card or online payment processors are used, processing may be subject to the provider’s own terms and fees if disclosed in advance.

 

 

6. Scheduling and Delays

 

Any start date or completion timeline provided is an estimate only and may change due to:

 

  • weather,

  • material availability,

  • labour availability,

  • site access issues,

  • change orders,

  • safety concerns,

  • unforeseen conditions,

  • events outside our reasonable control.

 

We will make reasonable efforts to keep you informed of delays.

 

 

7. Client Responsibilities

 

You agree to:

 

  • provide reasonable and safe access to the property,

  • ensure utilities such as electricity and water are available where needed,

  • remove or protect fragile, valuable, or personal items,

  • secure pets and keep children away from work areas,

  • disclose known hazards, defects, leaks, asbestos, mold, lead paint, or unsafe conditions,

  • ensure the site is ready for work at the scheduled time,

  • review and approve colours, finishes, and selections before materials are ordered or applied.

 

Unless otherwise agreed, the Client is responsible for moving small valuables, electronics, artwork, and breakable items.

 

 

8. Colour Selection and Product Choices

 

The Client is responsible for final colour and finish selection.

 

We are not responsible for dissatisfaction caused by:

 

  • colour choice after approval,

  • differences between paint chips, digital previews, and actual wall appearance,

  • lighting-related appearance changes,

  • normal manufacturer batch variation.

 

If the Client changes colours after materials are purchased or after work has started, additional charges may apply.

 

 

9. Surface Conditions and Preparation

 

We will perform reasonable preparation as included in the written scope. Unless expressly included, our services do not include major reconstruction, structural repair, engineering work, mold remediation, hazardous material abatement, or specialty restoration.

 

We do not guarantee a perfectly uniform finish where underlying surfaces are damaged, uneven, aged, previously patched, improperly primed, contaminated, or otherwise unsuitable.

 

 

10. Access, Occupancy, and Work Area

 

The Client agrees that work areas may be temporarily inaccessible during the project.

 

For safety and quality reasons, we may restrict access to active work zones until surfaces are dry or the work is complete.

 

 

11. Customer-Supplied Materials

 

If the Client supplies paint or materials:

 

  • we are not responsible for product performance, coverage, durability, colour mismatch, or manufacturer defects,

  • additional labour and material charges may apply if supplied products are unsuitable or insufficient,

  • no warranty is given for failures attributable to Client-supplied products.

 

 

12. Permits and Compliance

 

Unless expressly stated in writing, Bilasuvar Painting is not responsible for obtaining permits, engineering approvals, or specialized regulatory approvals.

 

The Client is responsible for informing us of building rules, condo requirements, access restrictions, and property-specific regulations.

 

 

13. Cleanup

 

We will perform reasonable jobsite cleanup at the end of the project. This generally includes removal of our basic tools, equipment, coverings, and ordinary work debris.

 

Unless included in writing, we do not provide deep cleaning, duct cleaning, hazardous waste disposal, or removal of pre-existing debris.

 

 

14. Inspection and Acceptance

 

The Client agrees to inspect the work promptly upon completion or substantial completion.

 

Unless the Client provides written notice of deficiencies within 3 business days, the work will be deemed accepted, except for latent defects not reasonably visible at inspection.

 

Minor touch-ups consistent with normal painting practice do not relieve the Client of the obligation to make payment when due.

 

 

15. Warranty

 

We provide a workmanship warranty of 2 years from the date of substantial completion, limited to defects directly resulting from our workmanship under normal use and conditions.

 

This warranty does not cover:

 

  • ordinary wear and tear,

  • fading, cracking, or peeling caused by moisture, water intrusion, structural movement, leaks, humidity, building failure, mold, mildew, or poor ventilation,

  • damage caused by abuse, impact, cleaning products, chemicals, pets, smoke, or third parties,

  • surfaces previously in poor condition,

  • manufacturer defects in products,

  • work where the Client supplied materials,

  • areas that were not properly disclosed or accessible at the time of quotation.

 

Our obligation under this warranty is limited to reasonable repair of affected areas. Refunds are not guaranteed unless required by law.

 

 

16. Limitation of Liability

 

To the maximum extent permitted by law, Bilasuvar Painting will not be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of use, loss of revenue, loss of business, or delay-related damages.

 

Our total liability relating to any claim will not exceed the amount actually paid by the Client to us for the specific services giving rise to the claim.

 

Nothing in these Terms limits liability where such limitation is prohibited by law.

 

 

17. Cancellation by Client

 

If the Client cancels after accepting the estimate or after materials have been ordered, the Client may be responsible for:

  • the cost of materials already purchased,

  • labour already performed,

  • scheduling loss or restocking charges, where reasonable and lawful.

 

If Ontario consumer-protection rules apply to the way the contract was formed, any mandatory cancellation rights provided by law will continue to apply. 

 

 

18. Suspension or Termination by Us

 

We may suspend or terminate services if:

 

  • the Client fails to pay on time,

  • the site is unsafe,

  • the Client or others interfere with the work,

  • required information or access is not provided,

  • there is abusive, threatening, or inappropriate behaviour,

  • conditions arise that make the project materially different from the quoted scope.

 

In such cases, the Client remains responsible for payment for work performed, materials purchased, and reasonable demobilization costs.

 

 

19. Photos and Marketing

 

Unless the Client objects in writing before the project starts, we may take before-and-after photos of the work for quality records and marketing purposes, provided no sensitive personal information, addresses, or identifying details are disclosed without permission.

 

 

20. Electronic Communications

 

By contacting us or providing your email address or phone number, you consent to receive communications relating to your quote, project, scheduling, invoices, receipts, and customer service.

 

Promotional emails or texts, if any, will be sent in accordance with applicable law and should include required identification and unsubscribe functionality where legally required. 

 

 

21. Website Use

 

If you use our website, you agree not to:

 

  • misuse the site,

  • attempt unauthorized access,

  • upload harmful code,

  • copy or reuse our content, branding, or images without permission.

 

All website content, including logos, text, graphics, and photos, remains the property of Bilasuvar Painting unless otherwise stated.

 

 

22. Privacy

 

Any personal information collected by us will be handled in accordance with our Privacy Policy, as updated from time to time.

 

 

23. Governing Law

 

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless another jurisdiction is stated in writing.

 

 

24. Dispute Resolution

 

Before starting legal proceedings, the parties agree to try to resolve disputes through good-faith discussions.

 

If a dispute cannot be resolved informally, either party may pursue remedies available under applicable law.

 

 

25. Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

 

 

26. Entire Agreement

 

These Terms, together with any signed proposal, estimate, invoice, scope of work, change order, and any document expressly incorporated by reference, form the entire agreement between the parties unless otherwise agreed in writing.
